Cannabis has not been fully legalized in Germany since 2024. Instead, it is partially permitted under clearly defined legal conditions. This article provides a neutral, legal overview of the current framework in 2025, including possession limits, home cultivation, seed regulations, and Cannabis Social Clubs.
This content is intended for legal orientation only. It does not provide cultivation instructions, does not promote consumption, and does not replace individual legal advice.

Legal foundations (status 2025)
With the entry into force of the German Cannabis Consumption Act (KCanG) on April 1, 2024, the legal treatment of cannabis fundamentally changed. This change does not constitute full legalization, but rather a limited legal permission under strict conditions.
In principle, handling cannabis remains prohibited. The law explicitly defines exceptions under which possession, cultivation, and handling are permitted or exempt from punishment. Only these explicitly defined exceptions are legally secure.
Only the permissions explicitly listed in the law apply. Any activity beyond these limits remains an административ offense or criminal act.
Permitted quantities and limits
| Context | Permitted | Notes |
|---|---|---|
| Public space | up to 25 g | Distance rules apply near schools, childcare facilities, and events |
| Private residence | up to 50 g | Must be stored securely and inaccessible to minors |
| Home cultivation | up to 3 plants | Per adult person, personal use only |
Private home cultivation
Private home cultivation of cannabis has been permitted since 2024 for the first time in Germany, but only within strict limits. Up to three living plants may be cultivated per adult person.
Cultivation is limited exclusively to personal use. Any transfer to third parties is prohibited. Plants and harvested material must be secured to prevent access by minors.
The legislator explicitly aims to prevent commercial structures and limits cultivation to controlled private use.
Legal status of cannabis seeds
The possession, purchase, and import of cannabis seeds are generally permitted. However, the country of origin is legally decisive.
- Seed purchases within the EU are legally privileged
- Imports from non-EU countries are subject to strict phytosanitary requirements
For private individuals, non-EU imports are usually impractical, as the required phytosanitary documentation is rarely obtainable.
A detailed legal explanation is provided in Cannabis seeds from the EU – what is allowed?.
Cannabis Social Clubs
Cannabis Social Clubs (CSCs) have been legally permitted since 2024 as non-commercial cultivation associations. They allow collective cultivation and limited distribution to registered members.
Clubs are subject to strict documentation, quantity limits, and regulatory oversight. Consumption within club premises is not permitted.
CSCs provide an alternative for individuals who cannot cultivate cannabis privately.
Cannabis and road traffic
Cannabis remains strictly regulated in road traffic. Even low levels of active THC may result in fines, driving bans, or license withdrawal.
Legal possession does not equate to fitness to drive. A sufficient time gap between consumption and participation in road traffic is strongly advised.
European context
Within Europe, Germany occupies a unique position. It neither applies full legalization nor strict prohibition, but a hybrid model combining limited permissions with regulatory control.
Comparative perspectives are available for Austria and Switzerland.
